Woman slips on syringe cap in patient's room at MD Anderson, sues for $1M

HOUSTON — A woman alleges she slipped on a syringe cap that had been left on the floor of a patient's room at MD Anderson in Houston. 

Juanita Rojas filed a complaint Aug. 23 in Harris County District Court against The University of Texas MD Anderson Cancer Center alleging negligence.

Rojas was at the MD Anderson Cancer Center in Houston to visit her son on Aug. 25, 2019, according to her complaint. She alleges that she slipped and fell on "what appeared to be a plastic syringe cap" that had been left on the floor in the patient's room and suffered injuries. Rojas claims MD Anderson's negligence for failing to protect her from the unreasonably dangerous condition and failed to warn of the danger. 

She further claims the defendant's nurses, doctors and other staff were the only ones handling syringes and plastic caps in her son's room and that they had actual knowledge of the danger. Rojas alleges as a result of her injuries, she incurred medical expenses, suffered disfigurement, pain, mental anguish and lost wages. 

Rojas seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. She is represented by Stephen Brice Burris of The Fears/Nachawati Law Firm in Dallas.
