Law firms bring two new lawsuits alleging commercial vehicle collisions

HOUSTON – A pair of lawsuits alleging commercial vehicle collisions were recently filed.

The first was brought by Cierra Brandon against Vega’s Logging, Edgar Vega and Derral Whisenhunt and filed in Liberty County District Court.

According to the lawsuit, on Aug. 4 Brandon was driving her vehicle on E. Houston

St. in Liberty County. Whisenhunt was operating a commercial vehicle and trailer owned by Vega’s Logging, an interstate freight shipping and trucking company.

“Defendant Whisenhunt failed entirely to operate his vehicle in a safe manner, and struck Plaintiff’s vehicle, despite Plaintiff having the right of way,” the suit states. “Defendant Whisenhunt admitted his light was red. Following the incident, Defendant Whisenhunt received a citation for failing to yield right of way.”

The second suit was brought by Ruby Martinez against Xstar Express and George Usakov and filed in Harris County District Court.

According to the lawsuit, on July 6 Martinez was driving her vehicle on South Crosby

Lynchburg Road in Harris County. Usakov was operating a commercial tractor-trailer owned by XStar Express, which is based in Belle River, Ontario, and has a fleet of commercial vehicles and drivers that transport fresh produce loads out of Canada to locations throughout the U.S.

“Defendant Usakov failed entirely to operate the vehicle in a safe manner, and while making a turn, struck Plaintiff’s vehicle,” the suit states. “Defendant Usakov received a citation for failure to drive in a single lane.”

The suits allege gross negligence and seek up to $1 million in damages.

In both cases, the plaintiffs are represented by attorney Andrew Dao of Daly & Black, along with attorneys Charles Sanders and Erica Rose of the Rose Sanders Law Firm.
