Woman allegedly trips on uneven surface in Dollar Tree parking lot, sues

HOUSTON — A woman claims she tripped and fell on an uneven surface in the parking lot while walking to the Dollar Tree in Porter. 

Tammy Niekamp filed a complaint Sept. 13 in Harris County District Court against Porterwood Shopping Center Investments LLC, Porterwood Shopping Center LLC doing business as Porterwood Shopping Center TX LLC, Porterwood Shopping Center LP and Porter Retail Center LTD alleging negligence. 

Niekamp claims in her suit that on Sept. 14, 2019, while in the parking lot of the defendants' premises located on US 59 in Porter and on her way to the Dollar Tree, she tripped and fell on a "hole/uneven surface" and suffered injuries. 

She alleges as a result of the fall, she suffered pain, disability, mental anguish, embarrassment, loss of earnings and incurred medical expenses. Niekamp claims the defendants' negligence for allowing the creation and continued existence of the dangerous condition on their parking lot and for failing to warn of the hazard. She also claims the defendants knew or should have known of the existence of the dangerous condition which caused her injuries. 

Niekamp seeks monetary relief of less than $250,000, interest and all other just relief. She is represented by Adam Criaco of Criaco & Associates in Houston.
