Nine month old suffers traumatic brain injury after falling off play equipment at daycare, $1M suit claims

HOUSTON — The parents of a nine month old who suffered a traumatic brain injury after falling off play equipment and onto a tile floor while at a daycare are claiming negligence. 

Erica Denise Harris, individually and Sheldon O'Neal Harris, individually and as next friends of C.S., a minor filed a complaint Oct. 4 in Harris County District Court against Gladebrook Learning Group LLC doing business as Linder Young Learners Academy negligence. 

C.S., who was nine months old at the time, was in the care of Gladebrook Learning Group in Houston on Oct. 20, 2018, according to the plaintiffs' suit. They allege that while C.S., was playing on a stationary activity center that was placed too close to a tile floor, he fell backwards, hit his head and suffered a traumatic brain injury that has affected his vision. 

The plaintiffs claim that C.S., had not developed his upper strength, balance or postural control to safely play on the equipment and that the defendants failed to properly hire and train employees to recognized the dangerous condition and risk of injury. They also claim the defendants failed to have proper supervision while the children were using the equipment and were negligent for placing the equipment in an unsafe area near the tile floor. 

The plaintiffs seek monetary relief of more than $1 million, interest and all other just relief. They are represented by Jonathan Cox of The Cox Pradia Law Firm PLLC in Houston.
