HOUSTON — A contractor who suffered a crushed foot when the brakes on an electric pallet jack allegedly failed is claiming negligence.
Dacoda Lucero filed a complaint Oct. 11 in Harris County District Court against Grants General Contracting LLC, The Kroger Co., and Quincy Parker alleging negligence.
Lucero, who was working for Grants General was repairing a racking system at the Kroger distribution center on May 31, 2021, according to his complaint. He alleges that while operating Kroger's electric pallet, which he had permission to use, he noticed the brakes failed to engage as he approached a pallet of water.
Lucero further alleges that in anticipation of the collision, he tried to step off the pallet jack which caused his foot to be crushed between the pallet jack and the pallet of water. He claims as a result of the accident, he suffered a debilitating injury to his foot and incurred significant medical expenses. Lucero also claims the defendants' negligence for failing to provide a safe workplace, failing to inspect and adequately maintain the equipment and failing to warn of the hazard.
Lucero seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Jim Hart, Eloy Gaitan and William Langley of Williams Hart Boundas Easterby LLP in Houston.
