HOUSTON — A renter who suffered burns while showering in his condo due to an allegedly improperly adjusted water heater is claiming his landlord's liability.

Pedro Cosme Diaz filed a complaint Nov. 9 in Harris County District Court against Blue Bell Place Builders LTD alleging liability.

Diaz alleges in his complaint that while showering at his condo which he rented from Blue Bell Place on Sept. 3, 2021, he suffered severe burns due to the water heater's temperature.

He claims the incident has caused him to suffer physical pain, mental anguish, impairment and incur medical care expenses. Diaz claims the defendant failed to properly install, maintain and inspect the water heater or properly adjust the temperature. He also claims that Blue Bell failed to warn residents of the dangerous water temperature or provide a safe living environment for its renters.

Diaz seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Steven Kherkher and Mohammad Abdel-Rahman of Kherkher Garcia LLP in Houston.
