Tenant assaulted at apartment complex by group of drunks, $1M suit claims

HOUSTON — A tenant who was assaulted by a group of intoxicated people is claiming the negligence of his apartment complex. 

Matthew Ersler filed a complaint Nov. 17 in Harris County District Court against Alliance Residential Management LLC, Broadstone Skyline Apartments and others alleging negligence and premises liability. 

According to his complaint, Ersler was a resident at the Broadstone Skyline Apartments. He alleges that while inside the premises on March 15, 2020, he was assaulted by "passerby's" who had been at a nearby bar drinking. 

Ersler claims the defendants failed to avoid use ordinary care "in aiding or protecting others from peril" and failed to maintain their premises in a safe condition including not having adequate lighting and having safeguards in place to protect him from injury. He also claims the defendants did not properly train security and failed to warn of the condition. 

He further claims that as a result of the assault, he suffered disfigurement, impairment, loss of earnings and incurred medical treatment costs.

Ersler seeks monetary relief between $250,000 and $1 million, interest and all other just relief. He is represented by Jeffrey McCarthy and Mike Takla of McCarthy & Associates PLLC in Houston.
