Woman alleges leaking refrigerator at Houston grocery store caused her fall, sues for $1M

HOUSTON — A woman alleges water leaking from a broken refrigerator caused her to slip and fall at a grocery store in Houston. 

Beverly Batiste filed a complaint Nov. 30 in Harris County District Court against The Tanza Group LLC doing business as Farmers Fresh Meat alleging negligence. 

Batiste was at the defendant's grocery store on Cullen Boulevard in Houston on Sept. 23, 2020, according to her complaint. She alleges that while on the premises, she slipped and fell on water that had been allowed to leak on the floor from a refrigerator in disrepair. 

Batiste claims the defendant knew or should have known about the dangerous condition and was negligent for failing to replace or repair the appliance or warn of the hazard. She also claims as a result of her fall, she suffered physical pain, impairment, disfigurement, lost earnings and aggravation of a pre-existing condition. 

Batiste seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. She is represented by Cynthia Huerta of Schechter Shaffer & Harris LLP in Houston.
