Ross Dress For Less worker claims improperly placed racks caused her fall, sues for $1M plus

HOUSTON — A Ross Dress For Less employee claims she fell on improperly placed clothing racks. 

Lourdes Rivera filed a complaint Dec. 9 in Harris County District Court against Ross Dress For Less Inc., alleging negligence. 

Rivera was working at the Ross Dress For Less on Boca Chica in Houston on May 21, 2020, according to her complaint. She alleges that as she was picking up clothes from the stockroom, her backside was facing a "number of large, metal clothing racks" which suddenly toppled over and caused her to fall on her back and knock her to the ground. 

Rivera claims Ross' policy was to have the clothing racks in "specific areas" of the stockroom marked with red tape and that the racks were improperly positioned which created a hazard. 

She also claims Ross failed to properly train its employees, implement safety protocols or enforce existing safety measures, did not properly supervise its employees and did not have the proper equipment for her to perform her job. 

Rivera alleges that Ross was also negligent for failing to provide her necessary assistance or warn her of the hazard. 

Rivera seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief.
