HOUSTON — A crew member working aboard a dive support vessel who fainted alleges a lack of sufficient crew caused him to be overworked.

Henry Osborne filed a complaint Jan. 3 in Harris County District Court against Cardinal Culinary Services LLC.

Osborne, according to his suit, was a crew member on the DSV Gulf Freedom dive support vessel on Nov. 29, 2021. He alleges that he was the sole chef working on the vessel and worked 18-hour shifts for five to six days and that being overworked caused him to faint and hit his head.

Osborne further alleges as a result of his accident, he suffered injuries to his head and neck and had to be transported back to the dock. He claims Cardinal Culinary has denied him payment or has delayed payments for his maintenance and cure and that they failed to have a sufficient and adequately trained crew and that two chefs were needed to serve the 25 member crew.

Osborne seeks monetary relief or more than $1 million, interest, trial by jury and all other just relief. He is represented by Anthony Buzbee, Ryan Pigg, Cornelia Brandfield-Harvey and Mauricio Guevara of The Buzbee Law Firm in Houston.
