Suit: Faulty machinery led to metal worker's fatal injuries

HOUSTON — The estate of a metal worker who suffered fatal injuries while working for Gulf-Tex Manufacturing is claiming wrongful death. 

Rachel Harp, Sarah Harp and Zachery Harp, individually and as legal representatives of the Estate of John Harp, deceased filed a complaint  March 8 in Harris County District Court against Gulf-Tex Manufacturing Inc., alleging wrongful death and negligence. 

The plaintiffs allege in their complaint that their 62-year old father, John Harp, was working for Gulf-Tex on Nov. 22, 2021, and was operating a vertical turret Lathe when he was caught in the lathe and suffered fatal injuries. The plaintiffs claim the machine did not have a protective guard to protect from hazards such as rotating parts. 

They further claim Gulf-Tex failed to remove excessive metal shavings on he floor around the machine and that their negligence led to an extreme degree of risk and the likelihood of serious injuries. The plaintiffs allege Gulf-Tex had awareness of the risk and failed to protect the rights, safety and welfare of its employee John Harp which caused them to suffer the loss of their father, mental anguish and incur funeral and burial costs. 

The plaintiffs seek monetary relief of more than $1 million, interest, trial by jury and all other just relief. They are represented by Gregory Fibich and Kenneth Fibich of Fibich Leebron Copeland Briggs in Houston and Charles Argento of Charles J. Argento & Associates in Houston.
