Suit: Houston-area HVAC Company failed to abide by arbitration agreement in consumer dispute

HOUSTON — A Harris County man's lawsuit is demanding a Houston-area HVAC business adhere to an arbitration panel's instructions to pay him following a commercial consumer dispute. 

Marc Bob filed a complaint  March 14 in Harris County District Court against Rosehill Enterprises LLC alleging breach of contract and violation of the Texas Deceptive Trade Practices Act.

According to Bob's suit, Rosehill, doing business under the expired trade name of Houston Admiral Services, agreed to arbitration for a commercial dispute. Bob claims on June 17, 2021, he was awarded $10,044 by the arbitration panel and that Admiral has refused to pay the award "despite proper demand" under state law. 

Bob further claims he was a consumer of Admiral and that the defendant is in breach of its contract. He alleges the defendant is also in violation of the Texas Deceptive Trade Practices Act for refusing to pay the award and for falsely represented they would abide by the terms of the arbitration panel. 

Bob seeks monetary relief of more than $30,000, interest and all other just relief. He is represented by Attorney Thomas Valega, Jr., in Houston.
