Houston apartment complex owners face suit after tenant was robbed, shot

HOUSTON — A tenant who was robbed and shot at his Houston apartment is alleging the complex owners negligence for lack of proper security. 

Dijour Turner filed a complaint April 5 in Harris County District Court against GPE 1331, LLC, GPE 13331-TIC2, LLC and The ValCap Group LLC alleging negligence. 

According to his complaint, Turner was residing at defendants' The Preserve at Westchase apartments on Meadowglen Lane in Houston. He alleges that on July 8, 2020, "an unknown person" robbed him, violently assaulted him and shot him at the apartment premises. Turner claims as a result of the incident, he has suffered physical impairment and disfigurement, suffered lost wages and incurred medical expenses. 

He alleges the defendants' negligence for failing to have reasonable security measures despite previous crimes at the apartment complex and that his risk of harm could have been prevented. Turner also alleges the defendants failed to have functional gates at the apartment complex to keep out intruders and failed to have a sufficient number of trained and licensed security staff to monitor and patrol and complex premises. 

Turner seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by J. Javier Gutierrez and David Gutierrez of The Gutierrez Law Firm Inc., in Bellaire and Jermaine Hayden of J. Hayden & Associates PLLC in Bellaire.
