Homeowner alleges window contractor damaged her home, breached contract

HOUSTON — A homeowner alleges her window contractor caused damage to her home and failed to install her new windows according to their contract. 

Margaux Teuscher filed a complaint April 4 in Harris County District Court against Lone Star Windows Inc., alleging breach of contract, violation of the Deceptive Trade Practices-Consumer Protection Act and negligence.

Teuscher alleges in his complaint that on Feb. 25, 2020, she entered into a contract with Lone Star Windows to replace windows in her home on Meadow Drive in Houston. He claims the contract included new jamb liners, weather stripping and "sash kits" in various windows. She further claims Lone Star committed to replacing the windows exactly as currently installed and that the new windows would be double pane. 

Teuscher alleges in April of 2020, the windows were installed without conforming to the specific conditions they had agreed upon including mismatched jamb liners, incorrect window sash footprints and differing window designs and glass. She claims in addition to breaching their contract, Lone Star Window falsely misled her to believe the windows would be aesthetically identical to the old windows and that they damaged several jamb liners in the home.

Teuscher seeks monetary relief of $250,000 or less, interest and all other just relief. She is represented by Guy Bily and Sanford Dow of Dow Golub Remels and Gilbreath PLLC in Houston.
