Man alleges contractor used materials he purchased for another customer's job

HOUSTON — A man alleges a contractor used the materials he purchased for another job without starting his project or refunding his money. 

Daniel Arevalo filed a complaint  April 9 in Harris County District Court against Jose Karim Garza doing business as Texan Buildings and Galvatec Inc., alleging breach of contract, fraud and other claims. 

According to his complaint, Arevalo entered into a contract with Texan Buildings on April 7, 2021, for $42,000 worth of numerous construction materials and $21,000 for labor. Arevalo claims he made a payment to manufacturer Galvatec for $21,000 and that after making the payment, several months went by without any communication from either of the defendants. 

Arevalo further claims that in August of 2021, he was contacted by Garza from Texan Buildings to inform him that the company was backed up and that construction start would be delayed. Arevalo alleges he asked for the construction materials he paid for to be delivered to his property with no response. He also alleges that in November of 2021, Texan Buildings attempted to deliver the materials with the condition that another $21,000 be paid but Texan failed to start the project or deliver the materials. He claims that Garza then admitted to using the materials for another project and failed to return them to Galvatec. 

Arevalo seeks monetary relief of $134,000, interest and all other just relief. He is represented by J. Luis Torres of The Torval Law Group PLLC in Houston.
