Worker alleges insect spray made roof slippery, caused his fall

HOUSTON — A roofer who suffered injuries after falling off a slippery roof that had just been sprayed for wasps is claiming the negligence of his employer, their customer and the job site owners. 

Jaun Sanchez Alvarado filed a complaint  April 12 in Harris County District Court against Next Generation Contractors LLC, Alpha Elite Roofing & Restoration LLC, Frank Banker and Gay Baker alleging negligence and premises liability.

According to his complaint, Alvarado was employed as a roofer with Next Generation who was hired for a job by Alpha Elite on a job site owned by the Bakers. He claims that as he was working on a roof that had been recently been sprayed with wasp repellant and was slippery, that he lost his footing and fell to the ground.  Alvarado alleges that he suffered severe injuries and had to be taken to the hospital by helicopter. 

He alleges the defendants' negligence for failing to provide a reasonably safe work environment, for creating a hazard and failing to warn of the hazardous conditions. Alvarado also alleges the defendants' negligence for failing to have adequate barriers to prevent his fall from a significant height, failing to implement proper safety policies and failing to train and supervise its employees or maintain and inspect the roof. He claims the defendants are non subscribers to worker's compensation and as a result of the fall, he suffered disfigurement, lost earnings and incurred medical bills. 

Alvarado seeks monetary relief of $250,000 and $1 million, trial by jury and all other just relief. He is represented by Michael Pierce and Mark Guerra and Pierce/Skrabanek PLLC in Houston.
