AUSTIN - Last month, Midland Memorial Hospital submitted two contingent fee contracts to the Office of the Attorney General for approval.
The request for approval was submitted on March 31, records show.
According to the request, the first matter involves claims against the hospital’s insurer for failure to properly pay a covered claim for hail damage. The second matter involves claims against various contractors for defective and deficient construction work that has caused damages to the hospital’s physical structure (the copper pipe claim).
“The Hospital pursued these claims without failing suit for several years,” the request states. “While some progress was made on the Hail Damage Claim, a significant portion of damages remain unpaid as to both claims. The Hospital has determined outside counsel is needed to assume control over these cases and initiate formal litigation.”
If the request is approved, the law firm of Crady Jewett McCulley & Houren would represent the hospital in both claims, records show.
