Two Texas school districts request AG approval to pursue storm claims against insurers

AUSTIN - Two Texas school districts submitted contingent fee contracts to the Office of the Attorney General last month seeking approval to pursue storm claims against their insurance providers.

Records show that San Felipe Del Rio CISD submitted its approval request on March 4. 

“Prior to engaging legal counsel, the District made a claim to its insurer regarding damages caused by storms that occurred on or about April 11, 2020 and April 28, 2021,” the request questionnaire states. “In response, the insurer failed to conduct a full and fair investigation of the District’s claims and refused to pay for all covered losses.” 

The law firms set to represent the district are Pearson Legal and Schulman, Lopez, Hoffer, and Adelstein.  

The second request was made by Donna ISD on March 8, records show. 

The district seeks approval of contingent fee agreement between it and the law firm of Flores & Pelaez-Prada for the possible litigation of a Hurricane Hanna claim.
