Uninsured motorist suit brought against Allstate

HOUSTON - A lawsuit seeking declaratory relief has been brought against Allstate Fire & Casualty Insurance Company over a collision with an uninsured driver. 

The lawsuit was filed by Hanh Phan and Thanh Tran on April 14 in Harris County District Court. 

According to the petition, on Aug. 30, 2017, the plaintiffs were traveling west on the access road of the Sam Houston Parkway and proceeding through a green light when an uninsured motorist rear-ended their vehicle. 

The impact caused severe property damage and personal injury, the suit states. 

The plaintiffs seek declaratory relief that Allstate provided them uninsured motorist coverage on Aug. 30, 2017 and that the negligence of the uninsured motorist caused the collision. 

The plaintiffs seek damages of $250,000 or less.
