Ferguson Law obtains TRO in 'catastrophic' I-10 18-wheeler crash

BEAUMONT - The Ferguson Law Firm has obtained a temporary restraining order on behalf of its clients arising from the April 11, 2022, 18-wheeler crash on Interstate 10.  

The order, obtained by firm managing partner, Paul ‘Chip’ Ferguson, was entered on April 27 by Judge Kent Walston of the 58th Judicial District Court of Jefferson County, Texas, a press release states.

“This was a catastrophic collision,” Ferguson said.  “One woman lost her life, and two others were severely injured.”  

According to the press release, the crash occurred at 10:30 on the morning of April 11 near the downtown exit on I-10. An 18-wheeler was traveling eastbound when it veered into the concrete barrier and crossed into the westbound lanes of traffic. The out-of-control 18-wheeler crashed first in Ms. Brooks, a 67-year-old resident of Bastrop, Louisiana.  She was pronounced dead on the scene and is survived by three children. The tractor-trailer then struck another vehicle occupied by Theresa Francios and Gloria Kitchen, both from Orange County. They were taken to a local hospital with life threatening injuries. Ms. Francois underwent spinal surgery and was released to home health care eight days later. Ms. Kitchen remains hospitalized following multiple procedures including several fusions to her spine.  

“The toll this crash has taken on these people is tremendous," Ferguson added.  "Once again, we find ourselves faced with another large truck that heedlessly crashes into a group of our citizens with disastrous results. One woman dead and two others lucky to be alive but, now, bent and crippled. It’s shameful.”

The TRO requires that all vehicles be maintained as well as related documentary evidence.  

“We sought this order to protect our clients," Ferguson said. "In cases of this magnitude, evidence in the control of the defendant sometimes will disappear. This preserves our evidence so that we can fully prove our case.

“It is an honor to represent these people. It will be our great honor to provide them with the justice and compensation they deserve.”
