Suit: AT&T, Verizon, others left dangerous grass-covered hole after underground cable installation

HOUSTON — AT&T, Verizon and others are facing a suit alleging a resident fell into a deep, grass covered hole that was left after installing underground cable in Auburn Lakes. 

Stephen Clifton Wallace and Theresa Marie Wallace filed a complaint April 25 in Harris County Disrict Court against AT&T, AT&T Corporation, Verizon Business Services and others alleging negligence. 

The plaintiffs allege that they were walking their two dogs on the sidewalks of the neighborhood in Auburn Lakes on May 3, 2021. They claim that as they approached the intersection with West Rayford Road, they crossed the street to avoid another person walking a big dog when Stephen Wallace stepped into a "deep, grass-covered, unmarked hole." 

They further claim as a result, Wallace suffered "severe and life-threating" injuries. The plaintiffs allege the defendants created the hole in March of 2021 where underground cable was being installed. They claim the defendants are negligent for creating the unmarked hole, allowing the hole to exist in an area where people walk and for not filling the hole. The plaintiffs allege the defendants also failed to mark or identify the hole with signage, tape, flags or paint and did not exercise reasonable care. 

The plaintiffs seek monetary relief, interest, trial by jury and all other just relief. They are represented by Donald Kidd and Adam Blake of Perdue & Kidd in Houston.
