Man claims Academy improperly assembled mountain bike resulting in crash

HOUSTON — A man claims a mountain bike that was improperly assembled by Academy Sport and Outdoors caused his crash and injuries. 

Thomas Dougherty filed a complaint May 2 in Harris County District Court against Academy Sport and Outdoors Inc., alleging negligence. 

Dougherty purchased a Ozone 500 adult mountain bike from Academy Sport and Outdoors on May 11, 2020, according to his complaint. He alleges that he paid extra to have Academy assemble the bike and when he attempted to ride it, the steering mechanism "froze in place" and caused him to crash into a mailbox. 

Dougherty further alleges he fell off the bike and onto the concrete pavement, suffered injuries to his back and head and had to go to the hospital due to a pounding headache, dizziness and vomiting. He claims Academy installed the front wheel fork on the bike in the wrong direction which made the bike impossible to steer. 

Dougherty also claims he suffered disfigurement, mental anguish and incurred medical care expenses. 

Dougherty seeks monetary relief of more than $1 million, interest and all other just relief. He is represented by M. Michael Meyer of The Bandas Law Firm PC in Corpus Christi.
