Customer claims she slipped on security tag at Forever 21 store in Houston

Lawsuits

HOUSTON — A customer claims she suffered serious injuries after slipping on a security tag that was left on the floor of a Forever 21 store in Houston.

Ashley Watkins filed a complaint May 5 in Harris County District Court against F21 OPCO LLC alleging negligence.

Watkins, according to her complaint, was inside Forever 21 at the Willow Brook Mall in Houston on Dec. 11, 2021. She alleges that she slipped and fell on a security tag that was on the floor and suffered severe injuries that required medical treatment and surgery.

Watkins claims the defendant's negligence for allowing the dangerous condition to remain on the floor and claims they knew or should have known of the risk of harm. She also claims the defendant was negligent for failing to correct the hazard in a timely manner and for failing to warn of the dangerous condition.

She alleges the defendants breached their duty of care by not assuring invitees had a safe surface to walk on while in the store. Watkins alleges she also suffered disability, disfigurement, impairment, mental anguish and incurred medical expenses as a result of her slip and fall.

Watkins seeks monetary relief, interest and all other just relief. She is represented by Donald DeSimone of The DeSimone Law Office in Houston.
