Houston apartment tenant alleges scalding hot water in shower caused his burns

HOUSTON — A Houston apartment tenant who was scalded when hot water suddenly came out of his shower is claiming negligence. 

Dwight Wayne McDonald filed a complaint May 5 in Harris County District Court against High Sierra Management Inc., alleging negligence and premises liability. 

McDonald claims in his suit that he was a tenant at the defendant's apartment complex on Reims Road in Houston on Nov. 22, 2020. According to his complaint, he suffered severe burns after "extremely hot" water suddenly came out of his shower with tremendous force. 

McDonald alleges High Sierra's negligence for failing to maintain and inspect its hot water heaters/boilers to ensure the dispensed water was not scalding hot. He also alleges High Sierra failed to warn of the dangerous condition and did not properly train its employees on proper management of the premises. 

McDonald claims as a result of his injuries, he suffered pain, mental anguish, loss of earnings, disfigurement and incurred medical care and related expenses. He also claims High Sierra did not exercise ordinary care in the ownership, possession, control and maintenance of its apartment complex. 

McDonald seeks monetary relief of more than $50,000, interest, trial by jury and all other just relief. He is represented by
