GALVESTON — Texas City Girls Youth Softball claims former board members used its equipment and funds to start their own athletic organization.
Texas City Girls Youth Softball filed a complaint May 20 in Galveston County District Court against Rachelle Davila, Dennis Davila, Gina Coovert and Angelique Clemente alleging conversion and breach of fiduciary duty.
The plaintiffs allege in their complaint that in late 2021 and early 2022, the defendants were outgoing members of the Texas City Girls Youth Softball organization. They claim the defendants, as board members, were in possession of Texas City Girls Youth Softball's property and documents when they decided to form their own organization in La Marque.
Texas City Girls Youth Softball alleges the defendants illegally removed the property and refused demands for accounting and access to the organization's funds in bank accounts. Specifically, the plaintiffs allege the defendants removed kitchen items, bats, balls, gloves and other sports equipment as well as an iPhone, iPad, raffle prizes and the keys to the property gates and concession stands.
They claim the loss of their items caused business interruptions, lost profits and that the defendants used their funds to set up their new organization.
The plaintiffs seek monetary relief of $250,000 or less, interest and all other just relief. They are represented by Duana Boswell-Loechel of The Boswell Law Firm PLLC in Houston.
