GALVESTON — A man alleges he was falsely arrested and charged with robbery by T-Mobile store employees while attempting to exchange a cell phone.
Bailey White filed a complaint June 15 in Galveston County Court against T-Mobile USA, Inc., alleging malicious prosecution and other claims.
White alleges in his suit that he went to the T-Mobile retail store at 61st Street and Stewart Road in Galveston on Sept. 16, 2020, to exchange a defective mobile phone he had purchased from the defendant. He claims that T-Mobile employees refused to help him with the data transfer to his new phone as promised and also refused to contact the corporate customer service agents to verify if the phone exchange was permissible.
White further claims the T-Mobile employees assaulted him, activated an alarm, called the police and initiated his criminal prosecution. According to his complaint, White was arrested on Oct. 8, 2020, for robbery, was no-billed for the felony offense by a Galveston County Grand Jury with the defendant then pursuing misdemeanor theft. He claims in his suit that the charges against him were dismissed on April 16, 2021, and that there was no probable cause for his robbery or theft charges. White alleges T-Mobile made false statements against him which caused him the aggravation of criminal prosecution.
White seeks monetary relief, interest and all other just relief. He is represented by Attorney Ramzey Zein-Eldin in Galveston.
