Attorney claims builder failed to fix construction defects on his Houston townhome

HOUSTON — A Bellaire attorney is suing the builders of his townhome alleging they fraudulently promised to fix multiple construction defects prior to his closing on the property. 

Scott Link filed a complaint July 11 in Harris County District Court against Lovett Custom Homes Inc., and 5177 Builders LTD alleging fraud and other claims.  

According to his complaint, Link decided to purchase a townhome in February of 2020, located in Alexandra Grove in Houston which was built by Lovett. He alleges that after two walk-throughs, the Lovett sales agent promised the unit would be finished and the defects in the construction removed. Specifically, he claims Lovett promised to fix the white paint on the floor, the low water pressure, the incomplete recessed lighting in the dining area, the uneven backyard, master shower, sheetrock damage above the garage door and the sloppy painting and calking throughout the unit. 

Link alleges that after closing on the unit on March 20, 2020, the construction defects were not corrected and that other townhome owners in Alexandra Grove have experienced the same treatment from Lovett. He further alleges the defendants fraudulently promised and made false representations that the defects would be fixed to induce him into entering a purchase contract. 

Link seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief.
