Fiesta Mart worker claims liquid from cleaning equipment caused her slip & fall

HOUSTON — A Fiesta Mart worker alleges she slipped on liquid leaking from a defective cleaning machine and suffered injuries. 

Liboria Garcia filed a complaint July 28 in Harris County District Court against Fiesta Mart LLC alleging negligence and premises liability.

Garcia, according to her complaint, was working at Fiesta Mart, a non-subscriber to the Texas Workers' Compensation program, on June 28, 2021. She alleges that as she was restocking shelves, she slipped and fell on a surfeit of fluid that was ejected by defective cleaning equipment and suffered injuries. Garcia claims Fiesta Mart's negligence for failing to maintain a safe working area and a safe work environment. 

She also claims Fiesta Mart was negligent for failing to properly inspect and maintain its premises and that it failed to repair the equipment. Garcia alleges Fiesta Mart did not implement and enforce safety polices and procedures and failed to warn of the dangerous and hazardous condition. She also alleges Fiesta Mart did not properly train its employees or comply with safety regulations and that they knew or should have known of the dangerous condition. Garcia claims as a result of her injuries, she suffered pain, impairment, disfigurement, lost wages and incurred medical costs. 

Garcia seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. She is represented by Nancy Flores of Abraham, Watkins, Nichols, Agosto, Aziz & Stogner in Houston.
