Homeowner alleges pool contractor failed to build proper foundation

GALVESTON — A homeowner alleges a pool contractor failed to construct a proper foundation which has caused the pool to crack. 

James Dickson filed a complaint  Aug. 9 in Galveston County District Court against Trahan Investments Inc., also known as Swimming Pools by Robert Trahan, alleging breach of contract, violation of the Texas Deceptive Trade Practices Act and other claims. 

According to Dickson's complaint, he entered into a contract with the defendant on May 18, 2020, for the construction of a swimming pool and other exterior features at his property in La Marque. He claims that beginning in July of 2021, the pool and paved areas began to develop cracks and that the pool's foundation was not built properly. Dickson further claims the stress of the pool's weight not being anchored caused the cracks as well as pressure on the bulkhead and boathouse on his property. 

He alleges the defendant negligently performed the work, failed to inspect the work and did not monitor its employees and contractors during the construction of the pool to ensure proper weight bearing to keep the pool from shifting. Dickson claims the defendant's actions constitute breach of contract in which they promised a pool free from defects and structurally sound. 

Dickson seeks monetary relief, interest and all other just relief. He is represented by Charles Dunkel, Jr., and Ashley Thompson of Thompson Dunkel Law PLLC in League City.
