Home Depot Customer alleges broken bag of landscaping rocks caused her fall

HOUSTON —  A woman alleges she fell on landscaping rocks that came out of a broken bag at a Home Depot in Houston. 

Esmeralda Ordonez filed a complaint  Sept. 27 in Harris County District Court against Home Depot U.S.A., Inc., alleging negligence. 

Ordonez, according to her complaint, was shopping at the Home Depot store on FM 1960 Road West in Houston on July 7, 2021. She alleges that as she was walking into the store, she fell on landscaping rocks that had spilled from broken bags at the entrance. 

Ordonez claims Home Depot was negligent for failing to place caution signs to warn of the broken bags of rocks or place barriers in the area. She also claims Home Depot failed to make the condition safe or to properly inspect and maintain its premises. Ordonez alleges as a result of her fall, she suffered pain, mental anguish, impairment and incurred medical treatment expenses. 

Ordonez seeks monetary relief between $250,000 and $1 million, interest and all other just relief. She is represented by Carlo Salvato, III of The Law Offices of Domingo Garcia LLP in Houston.
