HOUSTON - The 14th Court of Appeals concluded yesterday that a trial court did not error by granting summary judgment to defendants in a mold exposure lawsuit.
Court records show Selena McDade filed suit against Fountains at Tidwell, Hettig Management and Investors Management Group.
She alleged the defendants were negligent because they rented her a mold-infested apartment. She claims she began experiencing respiratory problems soon after moving into her apartment.
Court records show the defendants filed a combined traditional and no-evidence motion for summary judgment, which the trial court granted on all of McDade’s claims.
The 14th Court found that the trial court did not err when it granted the motion because McDade’s own summary judgment evidence conclusively established that the defendants did not breach a duty owed to her.
