Patricia Brito Perez has filed a lawsuit against a major grocery chain, alleging negligence that led to her sustaining serious injuries. The complaint was filed on March 28, 2025, in the District Court of Harris County, Texas, against Kroger Texas, LP and The Kroger Co., doing business as Kroger.
The incident at the heart of this case occurred on February 27, 2025, when Patricia Brito Perez visited a Kroger store located at 1505 Wirt Rd in Houston. While walking through the floral department, she slipped on a wet substance combined with a flower stem that had been left on the floor. Despite being witnessed by a Kroger employee who removed the flower stem, no warning signs were placed to indicate the hazard nor was the wet area cleaned. As a result of this alleged negligence by Kroger employees, Perez claims to have suffered significant and permanent injuries.
Perez's legal team argues that Kroger failed in its duty to maintain safe premises for its customers. The lawsuit outlines several accusations of negligence including failing to monitor and maintain safe conditions within the store, inadequately training staff on safety protocols, and not implementing or enforcing policies that ensure customer safety. Furthermore, they allege that Kroger did not provide adequate warnings about potential hazards nor took steps to rectify dangerous conditions once identified.
The plaintiff is seeking monetary relief amounting to $250,000 or less for damages including medical expenses, pain and suffering, mental anguish, and loss of earnings both past and future. Additionally, Perez seeks exemplary damages citing gross negligence on part of Kroger which allegedly showed conscious indifference towards her safety and well-being.
