Macy's shopper alleges substance on escalator caused her fall, injuries

HOUSTON — A shopper at Macy's in the Willowbrook Mall claims she slipped and fell on a substance that was on the escalator. 

Maria Alicia Resendez filed a complaint  Oct. 4 in Harris County District Court against Macy's Retail Holdings LLC alleging negligence and premises liability. 

Resendez claims in her suit that she was shopping at the Macy's store in the Willowbrook Mall in Houston on March 12, 2022. She alleges that while she was on the escalator, she slipped and fell on an "unknown substance" and "violently" hit the floor. Resendez claims Macy's negligence for failing to properly maintain the store and failing to warn of the dangerous condition. 

She further alleges Macy's failed to make the condition reasonably safe and that it posed an unreasonable risk of harm. Resendez claims as a result of her slip and fall, she suffered pain, disfigurement, impairment, lost wages and incurred medical expenses. 

Resendez seeks monetary relief of no more than $70,000, interest, trial by jury and all other just relief. She is represented by Annie Basu and Dan Pena of The Basu Law Firm PLLC in Houston.
