Lowe's customer claims employee struck her with hand truck, sues for $1M

HOUSTON — A Lowe's customer who suffered a severe leg injury after an employee allegedly struck her with a hand truck is claiming negligence. 

Doris Odell filed a complaint Oct. 4 in Harris County District Court against Lowe's Home Centers LLC alleging negligence. 

According to her complaint, Odell was at the Lowe's store in Pasadena on June 26, 2021. She claims that as she was standing in an aisle looking at merchandise, a Lowe's employee suddenly struck her leg with a metal platform hand truck. Odell alleges she suffered a "deep laceration" on her lower leg which then became infected and required hospital treatment. 

She further alleges that her injuries led to swelling and immobility of her left leg that resulted in treatment from specialists. Odell claims Lowe's was negligent for failing to adequately train its employees on the safe use of equipment and for failing to have adequate polices and procedures to ensure the proper use of merchandise-moving equipment. 

She also claims Lowe's failed to exercise reasonable care to avoid injuring individuals. Odell further claims she also suffered disfigurement and incurred medical expenses as a result of her injuries. 

Odell seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. She is represented by Clifford Peel, II of The Peel Law Firm in Houston.
