AUSTIN - Although Texas is sixth among states when it comes to the filing of medical malpractice lawsuits, the Lone Star State is second when it comes to the least costly med-mal reports, according to a NiceRx Health study.
The study, entitled Medical Malpractice Uncovered, explores which states have the most medical malpractice reports and the costs of those suits.
"At NiceRx, we decided to explore which states have filed the most medical malpractice suits, and which have paid out the most against these suits," the study states. "By looking at medical data over the last 10 years, we were able to explore this concept with a focus on modern-day medical malpractice."
As far as total med-mal reports go, New York had the most from 2012 to 2022 with 15,951 reports for a cost of $6,847,680, according to the NiceRx study.
California was second with 12,376 reports for a cost of more than $2.5 million.
Texas ranked sixth with 5,785 reports over the 10 year period for a cost of $1,052,210.
Only Maryland had a lower cost ($1,008,002) for med-mal lawsuits, according to the study.
Texas med-mal awards for non-economic damages are capped at $250,000 in cases against a single defendant and $500,000 for cases involving multiple defendants.
