Contractor who was paid allegedly failed to obtain permits, abandoned job

GALVESTON — A contractor who allegedly abandoned an outdoor patio project and failed to obtain proper permitting is facing fraud and other claims.

Antonio Hernandez and Yadira Hernandez filed a complaint Dec. 6 in Galveston County District Court against Outside Oasis Outdoor Living LLC doing business as Bullock Construction alleging negligence, fraud, breach of contract and violation of the Texas Deceptive Trade Practices Act. 

According to the plaintiffs' complaint, they hired Bullock for the construction of an outdoor patio for their home on Encino Avenue in League City. They allege that they paid the defendant $2,000 for permitting and that the total estimate for the project would be $30,000 with a six to eight week completion date. The plaintiffs claim that the work progress was slow, no permits were originally pulled and that the application was never sent to the HOA. 

They further alleged that the defendant abandoned the project, damaged their sod and the latch to their gate, failed to use caulking on the patio and incorrectly installed the light fixtures. The plaintiffs allege that electrical work and fireplace was incomplete and that the windstorm certification was also incomplete. They claim brick work and painting was left incomplete and that a new estimate to complete the project is $10,105.50. 

The plaintiffs seek monetary relief of $250,000 or less, interest and all other just relief. They are represented by Craig Saunders of Craig W. Saunders PLLC in Houston.
