Man allegedly trips over pallet left on wine shop aisle

HOUSTON — A man who tripped over a pallet left on the aisle of a wine shop in Houston and suffered injuries is claiming negligence.

Gilbert Labove filed a complaint Dec. 12 in Harris County District Court against Fine Wines & Spirits of North Texas LLC and Retail Services & Systems Inc., doing business as Total Wine & More alleging premises liability and negligence. 

Labove, according to his complaint, was at Total Wine & More on West Holcombe Boulevard in Houston on March 15, 2022. He claims he tripped over a pallet that was left on the shopping floor and "landed heavily" on the floor which caused him "serious bodily injuries." He alleges the defendants negligently allowed the pallet to remain on the floor unattended and with no caution signs to warn of the object on the shopping floor. 

Labove further alleges the defendants failed to remove the pallet and maintain safe walking aisles for customers. He claims the defendants knew or should have known of the dangerous condition and remedy the condition. Labove, according to his suit suffered pain, disfigurement, impairment, loss of earnings and incurred medical care expenses as a result of his fall. 

Labove seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. He is represented by Gabriel Gonzalez in Houston.
