A Texas man has sued a Galveston couple claiming he and his 2-year-old daughter were injured when they fell through a floor at the couple's house where they were staying in as a short-term rental.
In the lawsuit, David Glemser of Galveston County seeks more than $250,000 in damages against the property owners, Brad and Devon Heller, owners of the house at 728 Sherman Blvd. in Galveston. Glemser rented the house through Airbnb. Glemser's daughter is identified in the suit as M.G.
"Plaintiff David Glemser’s leg fell completely through the wood flooring on the first level of the house which was obviously in very poor condition," the suit says. "This caused him to fall while still holding M.G., whose face hit the floor when Plaintiff’s landed. This extremely dangerous condition was the direct cause of serious personal injuries to both individuals."
The injuries required Glemser and daughter to receive medical treatment as a result of the injuries, the suit says.
"Defendants had the highest level of duty owed to Plaintiffs, who were invitees on the property at the time of the incident, including the duty to warn Plaintiffs of any unreasonable risks on the land, as well as to inspect and make the property safe from unreasonable risky conditions," the suit says.
The injures were caused by the defendant's "negligent, careless and reckless disregard of these duties," it says.
