Buc-ee's customer alleges slip & fall due to spilled ice

HOUSTON — A Buc-ee's customer alleges he slipped and fell due to ice that spilled out of an ice machine. 

Jaime Espinoza filed a complaint Jan. 18 in Harris County District Court against Buc-ee's LTD alleging premises liability and negligence. 

According to his complaint, Espinoza was at Buc-ee's in Lake Jackson on Feb. 17, 2021, and alleges he suddenly slipped on accumulated ice that spilled out of an ice machine. He claims as a result of his fall, he suffered injuries to his knee and other parts of his body. 

Espinoza alleges Buc-ee's negligence for failing to detect the hazardous condition and not taking action to warn of the dangerous condition. He also alleged Buc-ee's failed to inspect and maintain the aisles of its store and provide a safe shopping environment. 

Espinoza claims Buc-ee's had employees who walked through the area prior to his fall and that the hazard was "deliberately ignored." He also claims as a result of his fall, he suffered pain, disfigurement, mental anguish, lost wages and incurred medical treatment expenses. 

Espinoza seeks monetary relief, interest, trial by jury and all other just relief. He is represented by Kenneth Baird of The Baird Law Firm in Houston.
