Woman alleges mother suffered life threatening bed sores at Houston nursing home

HOUSTON — A woman alleges her mother suffered from life-threatening bed sores while at a healthcare facility in Houston. 

Janet Nash, individually and as representative of the Estate of Mary Ruby Gardiner, filed a complaint Jan. 27 in Harris County District Court against Capstone Healthcare LLC alleging medical malpractice, wrongful death and other claims. 

According to her complaint, Nash's mother Mary Gardiner was a resident at Capstone Healthcare Center's facility on Fallbrook Drive in Houston. She claims while there in April of 2022, her mother developed "serious and life threatening" bed sores and required treatment from Houston Methodist Hospital. 

Nash alleges Capstone's negligence for failing to adequately treat and supervisor her mother while she was under their care, failed to properly assess her or properly train its nurses and staff on preventing and treating bedsores. 

Nash also alleges Capstone failed to provide her mother with critical care and other medical attention and negligently failed to screen, hire and supervise its staff in providing safe and sanitary arrangements for its residents. 

Nash seeks monetary relief, interest, trial by jury and all other just relief. She is represented by Timothy Ferguson and Mark Sparks of The Ferguson Law Firm in Beaumont.
