Couple allege default on $2 million promissory note

HOUSTON — A Harris County couple allege they are owed more than $2 million after a home technology company defaulted on a promissory note. 

Ben Mueller and Faye Mueller filed a complaint Feb. 1 in Harris County District Court against Premier Home Technologies LP and Eric Herleth.

According to the Mueller's complaint, the defendants executed and delivered a promissory note to them on Feb. 2, 2022 for the sum of $2,337,653.82 plus interest. The Muellers claim the terms of the note included a rate of three percent per annum and for the defendants to make monthly installments. They allege the note fully matured on Dec. 15, 2022, and despite their demands for payment, the defendants continue to default on their payment of the note. 

The Muellers further allege the unpaid interest from Dec. 15, 2022, through Jan. 30, 2023, is $8,749.67 with the total balance being $2,324,316.90. They claim the principal sum accruing after Jan. 30, 2023, at the "default per diem rate" is $634.03. 

The Muellers seek monetary relief, interest and all other just relief. They are represented by Attorney Stephen Toomey in Houston.
