Welder hit by steel beam alleges negligence

HOUSTON — A welder alleges he suffered injuries after a steel beam fell on top of him at a job site.

Fernando Adrian Lopez Moreno filed a complaint Feb. 5 in Harris County District Court against Innjoy Hospitality LLC doing business as Holiday Beach Resort and CV Welding alleging negligence and premises liability. 

Moreno, according to his complaint, was working at a job site owned by the defendants and was hired by CV Welding. He claims that as he was welding, a large piece of steel beam fell on him from above and caused him to suffer injuries. Moreno alleges the defendants' negligence failing to provide a safe work place, failing to have adequate staff and supervisors and failed to provide adequate equipment and tools. 

He also alleges the defendants did not take adequate safety measures or have protective equipment or proper training. Moreno claims he was not warned of the dangerous condition and that the defendants were in violation of OSHA regulations and standards. He alleges he has suffered disfigurement, impairment, lost wages and incurred medical expenses.

Moreno seeks monetary relief of more than $1 million, interest and all other just relief. He is represented by Muhammad Aziz and Alicia Patterson of Abraham, Watkins, Nichols, Agosto, Aziz & Stogner in Houston and Ignacio Martinez of The Ignacio G. Martinez Law Firm in Brownsville.
