Homeowner alleges land clearers mistakenly took out trees worth $15,000 to $30,000 each

GALVESTON — A homeowner alleges a land clearing company mistakenly took out eight trees on his property that were worth $15,000 to $30,000 each. 

Trent Bailey filed a complaint Feb. 27 in Galveston County District Court against Austin Land Clearing LLC and TXNFNC Enterprises LLC alleging fraud, negligence, breach of contract and other claims. 

Bailey, according to his complaint, entered into an agreement with Austin Land Clearing through their representative, Roeder, in August of 2022, to clear brush, complete a fence project and install at gate at his residence on North Baylan Street in Arcadia. Bailey claims that Austin's workers mistakenly took out eight large Eastern Red Cedar trees that were near the fence line. 

He further claims Austin's representative, Roeder, apologized for the mistake and claimed he failed to convey to the crew about the non-removal of the eight Red Cedar trees. Bailey claims that an arborist's evaluation of his property found that given the trees age of at least 25 years and the height of the trees being at least 45 feet, the replacement cost would be between $15,000 to $30,000 per tree. He also claims there is no evidence to support the defendants' claim that the trees were mulched and scattered onto his property and that he expressly instructed Roeder not to remove the trees. 

Bailey seeks monetary relief less than $250,000, interest and all other just relief. He is represented by Samuel Veenstra of The Veenstra Law Firm PLLc in League City.
