Dialysis patient suffers hip fracture after fall from treatment chair, sues Davita for failing to assist her

GALVESTON — A dialysis patient alleges she tripped while trying to get out of her treatment chair and fractured her hip. 

Jerri Martin filed a complaint April 12 in Galveston County District Court against Davita Kidney Care Contracting LLC, doing business as Davita-Island Dialysis Texas, alleging negligence and liability. 

Martin, according to her complaint, was a patient at Davita-Island Dialysis on April 14, 2021. She claims that she was not given any assistance from the staff as she got up from her dialysis chair and that she tripped on a portion of the chair and fractured her hip. 

Martin claims as a result of her hip fracture, she required surgery, staying at a rehab facility and incurred medical expenses of more than $100,000. 

She alleges Davita's negligence for failing to keep a proper lookout for her feet and legs, failed to assist her in exiting the chair and failed to safely manage the space around her involving the recliner extension. 

Martin seeks monetary relief, interest, trial by jury and all other just relief. She is represented by Wic Bonner of The Bonner Law Firm PC in Houston.
