GALVESTON — A mitigation company alleges a property owner failed to pay them more than $14,000 to repair water damage and clean and store personal property.
Bionic Emergency Services LLC filed a complaint May 19 in Galveston County District Court against Laurie McElreath alleging breach of contract, unjust enrichment and other claims.
According to Bionic's complaint, McElreath's property in Galveston sustained water damage on October 30, 2019. They claim they entered into an agreement for mitigation services with McElreath and provided cleaning, inventorying, packing, storage and the return of personal property to her for which McElreath has refused to pay. Bionic alleges they provided the labor, materials, storage and equipment per the contract agreement and that McElreath's failure to pay has caused them economic damages of at least $14, 798.56.
They also allege McElreath has received notice and demand for payment but has still failed and refused to compensate them for their work. Bionic claims McElreath's made false and material misrepresentations that she would compensate them for their restoration work on her property.
Bionic seeks monetary relief, interest and all other just relief. They are represented by Wendi Dodson of The Dodson Law Firm PLLC in Houston.
