Contractor alleges couple failed to pay for new home construction

GALVESTON — A contractor alleges a couple has failed to make a final payment on the construction of their new residence in Galveston. 

Peter Koumbis filed a complaint May 15 in Galveston County District Court against Tom Dayton and Carol Dayton alleging breach of contract. 

Koumbis claims in his complaint that he and the defendants entered into a contract in March of 2021, for the management of a construction project in Palm Key in Galveston. He alleges that between March of 2021, and September of 2022, he furnished services according to the contract and constructed a new residence for the Daytons. 

Koumbis claims that the Daytons have failed to pay the final payment of $27,061.16 to him for the project. He further claims he filed a lien on the property for the unpaid work. 

Koumbis seeks monetary relief, interest and all other just relief. He is represented by Richard Simmons and Janina Wojtkowski of Waldron & Schneider PLLC in Houston.
