Houston radio station alleges Columbian Fest organizer failed to pay for radio spots

HOUSTON — A Houston radio station alleges the organizers of the 2020 Columbian Festival failed to pay them for radio spots and name them as a sponsor of the event.  

Power 105.3 FM LLC filed a complaint July 3 in Harris County District Court against Jorge Herrera, individually, and Columbian Fest Intl., LLC alleging breach of contract. 

According to the plaintiff's complaint, the defendants have failed to pay for radio spots and advertising for the 2022 Colombian Festival. They claim they had an "oral contract" with the defendants to provide radio promotion and receive tickets and passes to the festival to give away at the station in return for being named and promoted as a sponsor. 

Power 105.3 alleges it provided the defendants with 1,061 - 30 second promos valued at $100 each and 450 -  60 second live reads valued at $450 each. They also allege the defendants not only did not pay as agreed, they only provided $46,500 in tickets and passes and also failed to name the radio station as a sponsor. 

The plaintiff seeks monetary relief of $250,000 or less, interest and all other just relief. They are represented by Daniel Lemkuil of The Law Office of Daniel Lemkuil in Houston.
