Lawsuit accuses Texas medical company of breach of contract, seeks more than $300K in damages

GALVESTON - Real Value Products Corporation of San Antonio has filed a lawsuit against Precision PHS, LLC DBA Precision RX and its purchasing agent and guarantor, Raul J. De La Vega, alleging breach of contract, and quantum meruit, saying Precision failed to pay on services rendered.

According to the suit, filed July 27 in Galveston County, TX, Real Value Products Corp. describes itself as "a seller and distributor of pharmaceutical and medical products," which it provides to pharmacies across the U.S. Real Value issues lines of credit to approved customers. The suit says Precision PHS, LLC, a company in Dickenson, TX, forfeited its existence with the Texas Secretary of State's Office, naming De La Vega as the responsible party to the company.

According to the filing, the defendants’ credit application was approved by Real Value on March 7, 2021. The plaintiff says it shipped products to the defendant, which the defendant accepted, for a series of months. Real Value says Precision and De La Vega was invoiced for each shipment, but did not pay as agreed. 

Real Value claims it is owed a balance of $349,867.88, saying, “Defendants have failed and refused to pay the balance due and owing under the Agreement.” Real Value says it made a final request for payment on May 2, to no avail. 

The plaintiff seeks actual damages, attorney’s fees, costs, interest and all other just relief. Real Value Products Corp. is represented by Pharra K. McDonald of Munck Wilson Mandala, LLP in Austin, Texas.
