HOUSTON - A lawsuit filed in Harris County District Court accuses Urban Restoration LLC with breach of contract, breach of warranty, gross negligence and violation of the Texas Deceptive Trade Practices act after allegedly failing to fulfill a $673,000 contract to repair a Houston property to the proper standard.
According to court discovery documents filed July 31 in Harris County District Court, the plaintiffs, Ray and Jacqueline Stephenson of Houston, entered into a $538, 721 reconstruction contract with Urban and their responsible officer Donald Warren, in December 2020. The suit alleges that Urban began restoration work much further back on the lot than expected, forcing the homeowners to extend the front of the home. In addition, the work forced the foundation of the home to sink, and "despite Stephenson' putting Urban on notice of these issues, Urban refused to address the issues," the documents read.
The company was also required to keep the plaintiffs on notice of costs incurred but failed to do so, according to discovery documents, and in October 2021, the company came to the plaintiff and asked for an additional $150,000 and more time to finish the project, to which the plaintiffs agreed after Urban showed them a detailed accounting of expenses for half the amount spent, despite the plaintiff requesting receipts for the entire amount.
To date, the documents read, the project is not complete, and Urban hasn't provided documentation on how the company pent the money paid, and with no work on the project being completed in months, the plaintiffs filed the suit seeking $673,000 in damages for lost money, in addition to court fees, attorney fees and interest.
