Galveston electric contractor sues former company executive for failure to perform duties

A Galveston County company is suing a company director and officer, alleging she breached her fiduciary duties and caused the company severe economic harm.

Shane Beall and Henry Beall Enterprises, doing business as A & H Electric, filed a complaint against Katherine Kelso July 28 in the 122nd District Court of Galveston County.

According to the suit, Kelso is a Beall family member who has served the company in the roles of vice-president, treasurer and director, and was responsible for A&H’s bookkeeping, accounting, and vendor payments.

The plaintiffs allege that Kelso “failed to perform her duties to the Company, concealed information, and – upon information and belief – took Company property for her own benefit.”

More specifically, the plaintiffs also allege, that Kelso “used drugs in the office, repeatedly caused vendors to be unpaid, and even very likely took A&H’s property.”

In the complaint, the plaintiffs ask the Court to help “identify and correct the other suspected harms.” They allege the defendant’s poor record-keeping has kept them from knowing the scope of the harm she caused.

Beall claims that as president, he took steps to protect the company that were challenged by the defendant.

The plaintiffs ask the court to place a trust over assets Defendant acquired through breach of fiduciary duty and an accounting of all assets, profits, revenues and property she possessed by virtue of her role in the company. They also seek monetary relief, penalty and punitive damages, attorney’s and legal fees and any other just relief.

The plaintiffs are represented by Patrick C. Bates of P. Bates Law PLLC in Houston.
